MommaE takes the bull(shitter) by the horns
In a new twist of events MommaE has filed a DEMAND TO CEASE AND DESIST AND RETRACT LIBEL order against Ed and Caren Hale, Plains Radio, and Bar H Farms. To add insult to injury Phil Berg’s office is representing her. In the order Ed has been demanded to retract his statements against MommaE immediately.
I guess that explains Ed’s sticky post in the Plains Radio forum where he says that Phil Berg is suing him.
Phil Berg has send us a letter stating that if we do not retract everything that we said about him, he will sue us. Ok Mr Berg, I retact all the lies I said about you. Hope this makes you happy and now I will continue to tell the truth about you. In my opinion, you have not won any case in court because you don’t have any evidence to back up what your case is about. You just grab something out of the air and try to make it look good so people will donate more money to you. I was on your web site the other day and you were asking people to donate $50 or get 5 of their friend to donate $10 each. Mr. Berg, we raised $10,000 for Steve Pidgeon and he still has money to use. How many $1000’s have you received and what did you do with that money? Have you published a report about where you spent their money? Why will you not tell the people who donate to you what is going on with your cases? Why did you send Oprah a letter? Was this a way to raise more money? The courts has turned down you cases as fast as you file them. Wonder why that is so Mr Berg? Mr. Berg, I will give you the entire 4 hours this Friday night to come on my show and answer these question and others. The problem is you will not do it because you know I will ask the hard question. This is your chance to set the record straight. You will have 1000’s of people listening and here is your chance to make your case to them, teh American people. If you think I have not told the truth aobut you, then come on the air and prove me wrong. Now Mr. Berg, you have the ball, what are you going to do with it? When asked for a reaction Ed Hale said “She’s a lying bitch, and I’m going to file a lawsuit against her tomorrow morning”. He also said that “Phil Berg isn’t licensed in Texas and couldn’t represent MommaE in a lawsuit” , calling the letter a “bluff”.
Below is a note from MommaE that she asked be included with the order.
To Who It May Concern:
As a result of Mr. and Mrs. Hale, Plains Radio Network, Inc. and Bar H Farms, Slanderous, Harassing, Defamatory, Threatening and Stalking Behaviors, I have had to hire Council to protect me and my interest.
Below is a Cease and Desist order, which is the first step in an attempt to stop these illegal behaviors. Please read it, as it will tell you what I have had to endure since the 21st day of August, 2008. While I would have preferred not to do this, I could no longer sit idly by and have my reputation destroyed any longer.

After I read Berg’s letter to Ed (for which Ed graciously described MommaE as a “bitch” on his boards), Philip Berg can represent MommaE in federal court. Berg is admitted to practice in federal courts, and this will be a federal lawsuit for these reasons: Ed and Caren Hale live in Texas. MommaE lives in Oklahoma. This gives them diversity (they live in different states). MommaE will definitely sue for more than $75,000.
Go for it, MommaE–and please depose Bugs about BigFeets!
Do we know if this Pastor Pigeon really exists? Perhaps he’s a friend or relative Ed is using to attract other pigeons. Would be convenient if Pastor Pigeon absconded with the fans’ funds.

I never realized that until dentist/lawyer Orly appeared on the scene that lawyers could be admitted to the bar after graduating from a correspondence school as she did. Now I’ve heard of night law school and part-time/weekend law schools like Hamline in Minnesota, but never a correspondence school like Orly went to. Apparently, California is the only state that admits lawyers from that school.
I just think back to Orly showing up in Texas for Jody (she’d filed a birther lawsuit, but had no clue as to what came next), and Orly making a bad situation completely chaotic, and then leaving. And now “citizen’s grand juries?” Lordy. Is Orly going to make herself judge?

I had a friend who had 55 gallon drums filled with all kinds of survivalist foods (TVP, anyone?) and would talk about the world in quite apocalyptic terms. When he’d get really wild-eyed, I’d just back away.

That’s what baffles me. Doesn’t matter where a person stands politically to me but I just don’t get why people like Ed (et al) go off on such crazy theories.
So Ed got a ‘cease and desist’ letter, or, as I like to call it, a ’stop and stop’ letter. It’s got to be pretty serious if plain old ceasing is not enough.
And look at the carbon copies! I understand why Mrs. Adams gets a copy. I don’t understand why Momma E Radio Rebels, Momma E and the Radio Rebels, and My Two Cents don’t get a copy. After all, this is a threat to file suit against not only Ed, but his wife, and his companies. Shouldn’t everybody involved be getting copies. Why did the letter leave out Ibhostnetworks? They host his website. Why did it omit KPRN, AM 1600 Radio? And what about the group of individuals on the Internet? I just don’t think it’s fair that they haven’t been given the opportunity to ’stop and stop’, like Ed, his wife, and his companies.

And is tortuous, or twisted interference, worse than straightforward interference? Well, as long as it isn’t tortious, I guess Ed, his wife, his companies and the cc’d kids are all ok - for now.

Money Magazine did surveys for a typical family with 50 accountants/tax specialsts several years running and got wildly different and wrong results from most of them. Along comes a more complex case like Daschle’s and the odds of getting it right have to be even less.
Some years ago, my father had a tax dispute with the government and won. I use his ruling to prepare my returns but my accountant still isn’t sure. Because my father fought for it, I feel that I should use the ruling he obtained.
Flawed tax filings is pretty shaky criteria if there isn’t obvious cheating going on yet the media hasn’t done much to present that side of it while the problem clearly exists.
I’m no big fan of Daschle nor do I have anything against him. I can only hope that a good, qualified and capable man or woman hasn’t been prevented from serving their country because of BS and media flawed perceptions of the tax code.

The only thing I’m concerned about is that I wouldn’t call it a valid survey. 1,000 respondents gives it a + or - 4 point margin of error and they oversampled Republicans by 441.
That isn’t too valid, considering that would mean that, in the sample, Republicans made up 44.1% of the population.

It is a request for documents in connection with the Keyes case but the image from the nutter’s website does not state what documents they want. My guess is that they are requesting those magical documents from the CIA that will show once and for all that Obama was born in a village in tahiti to muslim parents from Mars who are related to bigfeet and hate America.
This subpoena will go nowhere like everything else T’ain’t does. The CIA will easily quash this subpoena and will have several grounds to do so. Since this case is in California Superior Court, they likely need permission from the court to seek documents from an entity in another state (with the subpoena being served at Langley in Virginia). Anyone can deliver a subpoena to someone else by drafting a piece of paper and serving it on someone. I doubt the court issued the required commission. Also, on the more comedic relief side, they delivered it to the CIA visitor’s center.

I saw both a FOIA mentioned at Orly/Hale and a subpoena from Orly’s California case, so didn’t know what she was serving on the CIA.
I’d have to dig through Ed’s blahg and Orly’s website to figure out what was served on the CIA (please allow me to snork quietly for a while–I do wonder if they’re going to serve NSA and all the other various and sundry intel agencies in DC with this), but both of them list that whole slew of “magical documents” that prove, um, something.
I do know Orly’s been requesting people serve every US attorney and FBI office in every district in the US. I’d volunteer to serve someone in the USVI or Puetro Rico, because I’m sure Hawaii’s already taken, as long as my air fare, lodging and food are taken care of. I’ll need at least a week, maybe two, to find the offices, I’m sure.

Can you imagine someone in a US attorney’s office or an FBI field office getting this handed to him or her? Can you imagine this being copied and posted to the wingnut bulletin board in said office? Thanks for the reminder K Street that Orly Taint was born in the former Soviet Union. She says on her website that “Dr. Taitz escaped from the FSU over 20 years ago”. Now that must be hyperbole. I have some friends that went to Florida State. I know Tallahassee can be a rough place, but I don’t think you have to escape from there.

To clarify, dentist/lawyer Orly may be a naturalized citizen of the United States (I haven’t seen any evidence of that, however), the countries from which she immigrated–Russia or another of the countries which formed the former Soviet Union and Israel may still consider her a citizen, or she may hold dual citizenship. Only Orly Taitz, DDS Esq. has those answers.

Obama claims that he will have the most ethical administration in history, and he nominates Daschle, Holder, Giethner and now Leon Panetta.
All of these people have issues.
Giethner is heading the IRS, but yet can’t remember to pay his taxes AFTER being audited, and the very issue he “forgot” to pay his taxes on is brought to his attention. If he would have admitted that he had failed to pay his taxes for 2001, and 2002 THEN, I could consider it a “mistake”. But nooooo, he waits until he is nominated for Treasury.
Daschle in 1998 said that those who failed to pay taxes should be prosecuted to the fullest extent of the law, but is he? Noooooo
Obama says that “proserous” people will be held to the same standard as the rest of us, but then he nominates Holder, who recommended the pardon of Marc Rich for what? Oh yeah that would be because Rich’s wife gave lots of money to Clinton for his library.
Now Panetta who is nominated for CIA Director is accused of taking money from the very companies he will do business with.

Obama hasn’t even flown over the damage caused by this storm. People were disgusted that Bush was just flying over the damage of New Orleans and eating cake at a Birthday party, and has Obama even mentioned the damage and suffering of those affected by this storm?
Gibbs stands up in the daily press briefing and spouts about people looking at Obama’s ethics “policy” and says that they say it is the harshest of any administration. The problem is, Obama isn’t even following the policy he has set. What good is a policy, if the man who is supposed to administer it, doesn’t follow it?

I come here and see all of the comments about how good Obama is, and how he is for the middle class, and what a good looking man he is, and how he is going to bring change.

I have to disagree with you spin on the Obama Presidency thusfar. He’s been in office about 16 days now. Apparently he has made some mistakes and unlike the last commander-in-chief, he quickly admits his fault regarding any issues that has arisen in those 16 days.
I cannot comment on your comment for the simple reason that I see his presidency one way and you see it quite differently, as do many people. However, I will remind you of two things:
The majority of Americans who voted, voted for Obama.
The majority of Americans at this point in time have confidence in Obama’s vision for getting us out of this financial quagmire.
The minority have a strong voice with regard to legitimate issues about Obama’s policies. However, Obama’s opposition seems to be mainly made up of conspiracy theories about his birth, his citizenship and some would even suggest even worse.
IB, I have faith in the majority of Americans’ decisions (of which I am a member.)

When this poster says “tens of thousands of families lost everything,” he or she means EVERYTHING. Many of those people had everything they owned washed out into the Gulf of Mexico, including their homes. So many came back to just a slab of concrete, no trace of their homes except a few shredded pieces of 2 x 4’s, if that. They had to start from scratch, quite literally. There are people all along the Gulf coast who are still living in trailers and RV’s, trying to rebuilt, and the insurance companies have refused to pay out anything except minuscule amounts. And people who are geographically and climatologically ignorant have no understanding of the force of a hurricane, or the breadth. Hurricane Katrina affected people, not just in Louisiana, but east into Mississippi and Alabama. Add to that the damage from Charley, Frances, Ivan and Jeanne in Florida the previous year, and hurricanes Dennis, Rita and Wilma, caused devastation across the Gulf Coast, and the recovery from each hurricane takes at least two years.
Now there are some idiots who say, “well, don’t live there.” Sure, if you want to give up citrus fruits, orange juice and seafood, and give up major seaports across the Gulf and the Atlantic seaboard.
What morons.
You ignore that Tens of Thousands of families lost EVERYTHING, and they didn’t get it back when things thawed out and the power came back on. Most of them just came home and quietly rebuilt as best they could - and are still doing it.
IB — Would you like a rundown of Bush appointees vis a vis their qualifications and relationship to Bush and his campaign? We could put it up side by side with Obama’s appointees and use it for camparison. I would venture to guess Obama’s list would compare favorably against any past President’s list.
If you step away from the microscope and look at the bigger picture you might see that Obama is doing a pretty good job so far. He’s set a record for what he has accomplished in his first 3 weeks in office.

Unlike most here, I feel I know you, and though I don’t agree with most of what you say, I understand your points. The problem is that this is really not a totally political blog. Yes…the majority of people here are Obama supporters, but not all, and we didn’t start it up to discuss politics.
We are basically making fun of all the conspiracies surrounding the President. I know you feel that he isn’t vetted. Well…just like the “free markets”, if it was to someone’s advantage and there was some smoking gun out there, I have to assume that one of those anti-Obama types in a political position would have found him out. Alas, a whole lot of these conspiracies were literally started by bloggers who hated Obama and pulled it out of thin air. Do you remember where you first heard about the possibility of Obama being born in Kenya or a foreign student, etc, etc? He’s not going to spend his Presidency fighting those battles and I haven’t noticed the Constitution disappear.
If you have any comments on the birth conspiracies or any other craziness surrounding the President, you’ve found the right place. If you want to talk politics, you are better off with James. Now Barbour has vetoed previous increases, but Mississippi is still struggling to recover from the devastation of Katrina, he’s asking for an increase in the cig tax. The legislature hasn’t decided on how much, but the cig tax is most definitely going to be raised.

It’s pretty laughable that you consider a cigarette tax comparable to a promised income tax cut. A cigarette tax is a voluntary sin tax. Can’t afford it? Don’t smoke. I didn’t see any exemption for high income people in there. (btw I’m a smoker, and I think the tax could be even HIGHER - the tobacco companies will just lower their price to try to offset the increase like they always do.)
As far as the response to the ice storms, I have to agree with kstreet on that. First, to compare it to Katrina is LAUGHABLE. I was in New Orleans shortly after the hurricane and saw the devastation. Over 2,000 people died and tens of thousands of families lost EVERYTHING THEY HAD. And trying to compare the damage caused? I’m not sure where you get your figures but Kentucky is reporting somewhere over $45 million in damages so far compared to an estimate of Katrina damage of $85 billion.
Nevermind that FEMA was on the ground the day after assistance was requested by Gov. Beshears (who also praised Obama repeatedly for the fast federal response.)
You can complain about his cabinet picks all you want, or how much money was spent for the most highly attended inauguration in history, but when your other arguments are so fucking ridiculous, I don’t see any point trying to debate with you on that. Quite honestly debating with you, is a futile effort.
Just a little politics…I can’t resist. They are far from doing a perfect job, but there is an attempt, which is a start. I admit I’m not pleased about Geithner, but I have to say that I don’t know who has the proper credentials and would be clear of the industry. The taxes….he should have known. As for Daschle, I have to come right out and say that I have always been an enormous fan and I hoped HE would run for President so I’m not unbiased on his count. I figure he threw papers at his accountant and that was that. He didn’t have a 1099 for the driver service and it was a big oversight, but I don’t think intentional. I know his hands weren’t totally clean of the healthcare industry, but I do think he would have been effective and I am not happy that he withdrew, tax problem or not.
As to the cigarette tax…I didn’t know that was solely a middle class tax. Don’t you choose to start smoking…and trust me…I know personally the absolute horror of nicotine addiction. My 18 year old has been walking around with cigarettes lately. I don’t believe he’s addicted yet as he goes long periods of time without a smoke and I hope they make it so expensive that he thinks twice about wasting his money.

It is not my position that Obama SHOULD have done anything about the disaster in Kentucky. My whole point is the hypocrisy of those who criticized Bush for his handling of Katrina.

I would suggest to you that there were many people in Kentucky that have lost as much as those in New Orleans did.
I did not comment that I was outraged at his ignoring Kentucky. I feel he is doing whatever he can for Kentucky, just as Bush did for New Orleans. And no where in my comment did I make any statement about the looting or civil unrest, I limited my comment to the damage done.
I will always respect your opinion, and I would agree with Del that Obama deserves a chance, but with his promises to the middle class about not raising taxes, his 10 page “questionnaire” that he supposedly had his nominees fill out, his comment about the “prosperous” being held to the same standard as everyone else, the “stimulus” package that he allowed Pelosi to write, among other things, I feel that he is not off to the greatest of starts.
I am willing to give Obama a chance, but if or when his policies come crashing down on us (I predict inflation will rear it’s ugly head in a year or 18 months, BECAUSE of his so called “stimulus”), I am wondering if some of you will be ready to admit that Obama did not have the experience needed to be President.
I feel he would have been better off to stay in Washington for his full term as Senator, and learn how Washington works, instead he went all around the Country talking about “Change” and “integrity and transparency”, and when you look at what he has done in the first 17 days of his Presidency, I see none of this.

Politics aside, I have no quarrel with IB. He has shown me nothing but respect on BHDC and has really stuck his neck out to give me the benefit of the doubt when others were out for blood. Looks like the situation is now in reverse.
Say what you will about the man’s politics. As skewed as they might appear to most, IB is simply passionate about his believes as we are about ours.
For the most part, IB, we have no problem with stimulating conversation, but while you chastise Gilligan about her comments, you subtly threw your digs in yet, as Pete noted, you feel offended when in actuality you offended others first, and continued to do so in your subsequent posts.
I, for one, and possibly the only one, will overlook your grab at attention, but if you look back at your comments, there were a few personal attacks as well, only you used that method to point at us “collectively” instead of individually.
IB I will always respect you for a host of reasons. However, I find it difficult to defend you when you accuse others of being less than honorable when you yourself are doing the same thing.
It is easier to defend someone with the proverbial “clean hands” than to defend someone with a possible ulterior motive. Having said all that, like Del, in terms of your political rhetoric, I may not agree with you, but I do defend your right to say it. Conversely, I cannot say the same for an attack on this blog and its bloggers because of some hidden animosity, IB.

(CNN) — Students at former Ludlum Elementary School made history when their school became the first in the nation to be renamed after President Barack Obama. It’s virtually unheard of to name an educational institution after a sitting president. Students and parents gathered for the official name change ceremony Wednesday morning where the “Barack Obama Elementary School” sign was unveiled.
During the campaign season, the children became interested in the election, participating in mock presidential debates at the Long Island elementary school — which sits in close proximity to Hofstra University, the site of the final presidential debate.
They began the movement to officially change their school’s name to honor the 44th president. Following the election, the Hempstead School Board voted unanimously to adopt the resolution after students read their written requests to make the name change permanent.
After the inauguration, all 466 students received navy sweatshirts from the school with the words “Yes We Can” emblazoned in English and Spanish. The school is roughly 60 percent Hispanic and 40 percent African-American.
President Obama was invited to the ceremony, but was unable to attend.

(CNN) — Justice Ruth Bader Ginsburg had surgery Thursday for early stage pancreatic cancer, the Supreme Court announced.
Ginsburg, 75, underwent surgery at Memorial Sloan-Kettering Cancer Center in New York City, the court said in a news release. It said she will likely remain in the hospital for the seven to 10 days, according to her attending surgeon, Dr. Murray Brennan.
“Justice Ginsburg had no symptoms prior to the incidental discovery of the lesion during a routine annual check-up in late January at the National Institutes of Health in Bethesda, Maryland,” a court spokeswoman said in the statement.
A CAT scan “revealed a small tumor, approximately one centimeter across, in the center of the pancreas,” she added.
Ginsburg was appointed to the Supreme Court in 1993 by President Bill Clinton.

The sad thing is that pancreatic cancer usually doesn’t have any symptoms until it metastasizes. It’s a stealth cancer with a very poor survival rate. I’m hoping Justice Gingsberg is one of those who beat the odds.

Schulz is under investigation by the IRS for tax evasion.

What this means is Judge Robertson wants a hearing in open court about the qualifications of Berg and Joyce. The judge can deny their motion for being allowed to practice in this case in that district.

Usually if a lawyer wants to bring a case and appear in court in a state when he or she is not licensed (for example, Berg is licensed to practice in Pennsylvania, but is not licensed to practice in the District of Columbia), the lawyer will file a motion to be allowed to represent his or her client for the purposes of that case (see the simple definition of “pro hac vice,” above) and the judge grants the motion. It’s all done by paper. Having this motion heard in open court so the judge can “examine their credentials, their competence, their good faith, and the factual and legal bases of the complaint they have signed” means a BIG EMBARASSING slap in the face to Berg and the other counsel.
I remember one case where this lawyer from another state (but not licensed in ours) just showed up to represent his client in a criminal case. The judge was not pleased, a little cranky, in fact, because all of that was to have been taken care of before the lawyer just showed up. What this judge is doing to Berg and the other counsel is unusual to say the least, and I suspect the judge is going bitch slap these guys BIG TIME.

The bottom line is that Berg is a loser. But that is more a factual analysis than a legal one! Pro hac vice means that you are not licensed to practice in that court but the court will allow you to practice for one particular case. Courts have the discretion to deny a pro hac vice application but I have NEVER seen that happen. And I have never seen the judge request information like he is doing from Berg. And I have seen some frivolous cases. It’s basically pro forma so the judge’s order is a smackdown. i think Gilligan may be right about an impending “bitch slap”.
One technical note although it might be boring to some. You have to be admitted to the federal court in question even if you are admitted in the state where the court is. So even if you are admitted in the D.C. bar you have to get a pro hac to practice in the Federal Court in D.C.
On another point, this case will get dismissed — I am as certain of that as I am that Bugs has never seen bigfoot. But the Defendant has to make the motion for that to happen. The court, absent circumstances not present here, will not dismiss a case sua sponte — meaning at its own prompting.
I have to say this….. The regulator has one top legal dept!

What’s funny about the comments on the case is the birthers are saying, “the case is still alive!” It hasn’t dawned on them that if the judge refuses the pro hoc vice motion, these lawyers can’t practice in that court, so either the plaintiff has to get new lawyers, the plaintiff goes pro se, or the case is DOA.
I’ve never heard of a judge not just signing the motion either– but instead having a hearing about it? That was the stunner. I don’t think it’s dawned on the birthers that Berg and his co-counsel are about to be grilled in open court by a judge concerning “credentials, their competence, their good faith, and the factual and legal bases of the complaint they have signed.” Their “competence?” Holy crap. I mean I’ve heard judges blister lawyers (sometimes so forceful the door bulges out), but that’s done in chambers, not in open court and this one’s going to be out there for all to see (or at least read). This looks like it could be VERY uncomfortable for Berg and his co-counsel (and lawyers are rarely on the receiving end of a grilling from a judge and lawyers make lousy witnesses), and very entertaining for those watching.
Oh, I wish I could be there. This might be as fun as dentist/lawyer Orly in that court in Texas, getting her ass handed to her.
Courts have the discretion to deny a pro hac vice application but I have NEVER seen that happen. And I have never seen the judge request information like he is doing from Berg. And I have seen some frivolous cases. It’s basically pro forma so the judge’s order is a smackdown. i think Gilligan may be right about an impending “bitch slap”.
One technical note although it might be boring to some. You have to be admitted to the federal court in question even if you are admitted in the state where the court is. So even if you are admitted in the D.C. bar you have to get a pro hac to practice in the Federal Court in D.C.
On another point, this case will get dismissed — I am as certain of that as I am that Bugs has never seen bigfoot. But the Defendant has to make the motion for that to happen. The court, absent circumstances not present here, will not dismiss a case sua sponte — meaning at its own prompting.
When are these people going to learn that they are wasting their time with these lawsuits? I believe they are just a way to scam money out of people. It is a real shame that American people can’t just accept Obama as President and hope he does a good job. Every President deserves our support and so does President Obama. It looks like he is trying to help straighten our economy out.

Plains Radio Candidate Can Make Supreme Court Define Natural Born
What if Plains Radio forms a political party, wants to choose a candidate (Ed), but has to sue the Democratic Party regarding their definition of Natural Born…the DNC has laws in its organization that say they will choose a candidate according to the Constitution and the states trust them to do this, and all the candidate does is sign, yes they are qualified. So Plains Radio can form a party, and sue the DNC on their definition and challenge it, saying the DNC defines it as one citizen parent and not born here, due to Obama with one US parent, one Kenyan parent and born in Kenya. Plains Radio defines it as two citizen and born here. This would force the courts to decide and set a legal definition of Natural Born by the courts. It would also confirm the legal status of Obama as not Natural Born. ???

The desparation out there among the birthers is amazing to me. It is plain that what they object to is having an African-American President who actually traveled overseas and doesn’t own a ranch in Texas. Although I find the cases crazy and wasteful of the court’s time, they can be entertaining. One of my favorite funny cases was where a guy was trying to sue Satan for emotional distress. The court, playing it entirely straight, dismissed the case because it said it could not obtain jurisdiction over Satan since he did not reside in the area. Personally, I think this guy had a better chance suing Satan than does Berg et al. with all their crazy lawsuits. What the DNC does for candidate selection is none of another party’s business so it’s an ill conceived suit as written. They would have to belong to the Dem party.

I wonder if Turner is going to get a slot on Plains Radio?
Ed can’t claim naivete about Hal Turner. A simple google search on “Hal Turner” turns up the absolute fact that Hal Turner is a neo-Nazi, and Turner’s very proud of his racist and anti-Semitic views.
